Legal bases for tachometer adjustment / manipulation / tachometer setting
According to § 22 b StVG the misuse of odometers and speed limiters is punishable by law. However, according to the case law of the Federal Constitutional Court, software for repair, adjustment or restoration of the original mileage is legal.
According to this case law, there is no falsification within the meaning of § 22 StVG if the odometer is manipulated for the purposes of repair, adjustment, conversion or data restoration, because these actions are aimed at guaranteeing or restoring the proper functioning of the odometer, i.e. at displaying the actual mileage of the motor vehicle.
However, manipulation of odometers for the purpose of fraud is punishable by law. Therefore applies with us:
Before placing an order, we require an affidavit from you in which you declare that the speedometer installed is not the one originally installed by the manufacturer and that you wish to have the real mileage set in the used speedometer.
We expressly point out that the installation of tuning products (e.g. modified control units/additional control units etc.) can lead to the loss of the guarantee or warranty obligation of the vehicle manufacturer or vehicle seller. The increase in performance of motor vehicles requires a retyping with regard to motor vehicle liability insurance. The buyer himself is obliged to ensure that the insurance cover is maintained. He releases us from any liability. Liability for damage to other parts and consequential damage (e.g. installation damage, engine damage etc.) is expressly excluded.
We further expressly point out that the speedometer adjustment is carried out exclusively for repair purposes.
Is the speedometer adjustment permitted?
For legal reasons, we are only allowed to adjust the speedometer to the real, i.e. actual, level on used or new speedometers that were not originally installed in this vehicle. If you have changed your speedometer in the past and would like to change it again to avoid committing a crime, please contact us to adjust the speedometer to the correct mileage. The speedometer adjustment is prohibited for leasing and rental vehicles!
